Pengertian Mahram dan Wali Nikah, Siapa Sajakah Mereka?

Mahram nikah adalah perempuan-perempuan yang tidak boleh dinikahi dan hukumnya adalah haram, mengenai siapa saja mahram nikah dan hukumnya sudah disebutkan dalam Al-quran dan hadits, seperti yang telah disebutkan di dalam surah An-nisa’ ayat 22 dan 23.

Dapat disimpulkan bahwa ada 3 faktor yang menyebabkan mahram nikah atau seseorang tidak boleh dinikahi oleh si laki-laki, faktor keturunan, faktor persusuan dan faktor perkawinan.

Faktor keturunan

1. Ibu
2. Ibu dari ibu (nenek) dan seterusnya ke atas.
3. Anak, cucu dan seterusnya ke bawah.
4. Saudara perempuan kandung.
5. Saudara perempuan seayah (satu ayah lain ibu).
6. Saudara perempuan seibu (satu ibu lain ayah).
7. Saudara perempuan ayah.
8. Saudara perempuan ibu.
9. Anak perempuan dari saudara laki-laki dan seterusnya.
10. Anak perempuan dari saudara perempuan dan seterusnya.

Faktor Persusuan

Perempuan-perempuan dibawah ini haram dinikahi karena disebabkan satu persusuan.
1. Ibu yang menyusui (bukan ibu kandung)
2. Saudara perempuan sepersusuan (ibu susuan yang sama)

Faktor perkawinan

1. Ibu dari istri (mertua).
2. Anak tiri
3. Istri dari anak (menantu).
4. Istri bapak (Ibu tiri).

Pengertian Wali nikah

Wali nikah adalah orang yang mempunyai hak menikahkan seorang perempuan kepada seorang laki-laki sesuai dengan syariat Islam yang berlaku.

Syarat Menjadi Wali Nikah

Wali dari pengantin perempuan harus memiliki syarat-syarat berikut:
1. Laki-laki
2. Muslim
3. Baligh
4. Berakal
5. Tidak fasik (bukan pelaku dosa besar dan dosa-dosa kecil)
6. Memiliki hak menjadi wali

Pentingnya Wali Nikah

Seorang wali dalam sebuah pernikahan sangat penting dan krusial karena ia menjadi salah satu penyebab sah atau tidak sahnya sebuah pernikahan. Perempuan yang menikah tanpa wali hukumnya tidak sah alias batal.

Rasulullah saw. Bersabda:

لاَ نِكَاحَ إلَّا بِوَلِيٍّ مُرْشِدٍ (رواه الشافعي)

Artinya:
“Tidak sah pernikahan kecuali dengan wali yang mursyid.” (HR. Asy-Syafi’i)

Tingkatan Wali Nikah

Secara umum wali nikah dibagi menjadi dua,
• Wali nasab
Wali nasab adalah wali nikah karena ada hubungan darah atau kerabat.
• Wali hakim
Wali hakkm adalah orang yang dilimpahkan hak untuk menjadi wali nikah karena keadaan dan sebab tertentu.

Sebagian para ulama, seperti ulama mazhab Syafi’i, Hanafi dan Hambali menambahkan, bahwa orang yang memiliki budak dan budak tersebut kemudian ia merdekakan, maka ia berhak menjadi wali nikah budak tersebut jika tidak ada wali nasab, artinya mantan sayid budak tersebut menjadi wali hakim bagi mantan budak tersebut.

Perpindaban hak wali kepada wali hakim dikarenakan tidak adanya wali nasab, atau gugurnya hak wali nasab dikarenakan hal-hal tertentu seperti murtad, gila dan lain-lain.

Urutan prioritas wali nikah adalah sebagai berikut:

1. Ayah kandung.
2. Kakek dari pihak ayah, atau seterusnya ke atas.
3. Saudara laki-laki kandung (seibu seayah).
4. Saudara laki-laki se-ayah.
5. Anak laki-laki dari saudara laki-laki kandung.
6. Anak laki-laki dari saudara laki-laki se-ayah.
7. Paman (saudara kandung ayah).
8. Paman (saudara ayah se-ayah).
9. Anak laki-laki dari paman kandung.
10. Anak laki-laki dari paman se-ayah.
11. Wali hakim.

Menurut imam Asy-Syafi’i urutan wali nikah tersebut adalah wajib artinya harus diprioritaskan sesuai urutan yang telah disebutkan diatas jika wali pada urutan pertama tidak ada, maka wajib haknya kepada wali pada urutan kedua, begitu seterusnya hingga pilihan terakhir adalah wali hakim, seumpama wali kepala KUA, atau guru ngaji, atau ulama.

Macam-Macam Wali Nikah

1. Wali Mujbir

Secara bahasa mujbir artinya orang yang memaksa. Sedangkan menurut istilah adalah wali yang mempunyai hak untuk menikahkan orang yang ia walikan, tanpa menanyakan dulu pemdapat atau meminta izin dari mereka.

Wali mujbir berlaku bagi si perempuan yang kurang kemampuannya, seperti anak yang belum sampai umur atau tamyiz (dewasa), berlaku pula misalnya kepada si perempuan yang kurang sempurna akal pikirannya.

Wali mujbir diakui dalam agama karena mempertimbangkan kepentingan perempuan yang diwalikan. Karena orang yang kirang kemampuannya kurang bisa memikirkan kemaslahatan ditinya dengan baik. Maka, semua persoalan orang seperti ini harus diserahkan kepada walinya, misalnya masalah harta atau nikah.

Para ulama menjelaskan bahwa yang berhak menjadi wali mujbir bagi perempuan yang kurang sempurna akalnya adalah ayah kandungnya, kakeknya dan seterusnya. Adapun menurut imam Syafi’i hak wali berada di tangan ayah dan kakeknya.

Menurut para ulama, seorang perempuan boleh dinikahkan tanpa meminta izinnya terlebih dahulu jika:
1. Hendaklah dinikahkan dengan lelaki yang setara (sekufu) atau kafaah.
2. Maharnya tidak kurang dari mahar misil (sebanding).
3. Tidak dinikahkan dengan laki-laki yang tidak mampu memberi mahar.
4. Tidak dinikahkan dengan laki-laki yang jahat, yang mengecewakan atau membahahakan si anak perempuan kelak.

2. Wali hakim

Wewenang wali nikah berpindah ke tangan wali hakim dikarenakan oleh 2 macam hal, yaitu:
– terjadi pertentangan atau perselisihan diantara para wali nikah.
– Tidak adanya wali nasab, baik karena meninggal, hilang atau ghaib.

Jika calon suami yang sekufu telah datang meminang dan calon istri telah setuju, sementara itu walinya tidak ada, maka wali hakim berhak menikahkannya.

Rasulullah saw. Telah menegaskan di dalam hadits yang mulia:

ثلاث لا تؤخّر وهنّ الصلاة إذا أتت والجنازت إذا حضرت والأيمّ إذا وجدت كفاءً

Artinya:
” Tiga perkara yang tidak boleh ditunda-tunda, shalat jika telah tiba waktunya, jenazah bila telah siap (dikebumikan), dan gadis-gadis bila telah mendapatkan pasangannya yang sepadan.”

3. Wali Adhal

Wali adhal ialah wali yang enggan atau menolak untuk menikahkan perempuan yang berada dibawah tabggung jawab perwaliannya. Para ulama sepakat bahwa seorang wali tidak menolak untuk menikahkan perempuan yang menjadi tanggung jawabnya sebagai wali ketika ada laki-laki yang kafaah yang ingin menikahi si perempuan tersebut dengan mahar mitsil yang telah di setujui.

Jika dalam keadaan tersebut wali menolak menikahkan si perempuan tanpa alasan yang jelas, maka perempuan tersebut harus mengadukan hal tersebut ke wali hakim dan memintanya untuk menjadi wali hakim pernikahannya.

Dalam keadaan seperti itu, masalah pernikahan tidak pindah kepada wali nasab lain sesuai urutan, akan tetapi langsung pindah ke tangan wali hakim, karena wali adhal itu suatu tindakan aniaya. Namun, bila penolakan menikahkan itu berdasarkan pertimbangan yang jelas dan masuk akal seperti tidak sekufu atau maharnya tidak mencapai mahar misil, maka perwaliannya tetap berada di bawah tanggung jawab wali nasab tidak berpindah kepada wali hakim.
